In Tarrant County Criminal District Court #2 in Fort Worth, Texas, we’re proud to walk away from another hash oil case with a dismissal.  Following a year of fighting about the accreditation of the lab the state used, they finally conceded they could not prove it was legitimate and dismissed the case.

NOT GUILTY – Felony Theft 1/19/17

Daniel Mehler and Megan Roper combined for a not guilty in the 144th District Court on a felony theft case. After a vigorous cross examination, several jurors told us the state simply did not produce enough credible evidence for a conviction. Another great win!

NOT GUILTY – Assault & Harrassment – 1/9/2017

Another big win, this time out of Adams County, Colorado. Daniel Mehler, working with local counsel Said Sharbini, secured a not guilty in Division 7 of Adams County Court. After objecting to a variety of the State’s evidence and witnesses, Mr. Mehler moved for a motion to acquit the defendant and the Court granted a not guilty due to the State having presented insufficient evidence to convict the accused.

A big win in Bexar County Court at Law 14 with The Honorable Paul Canales presiding. Working with co-counsel Robert Gebbia, Daniel Mehler was able to secure the first medical marijuana jury charge ever given in the State of Texas. What this means is that a judge actually instructed a criminal jury on medical marijuana as a part of Texas law for them to consider.  Mr. Mehler argued that the jury was entitled to an instruction under 487 of the Texas Health and Safety Code and the Court agreed. Yesterday, we picked a jury in Bexar County Court #1 in San Antonio, Texas.  Our client was in court on a possession of marijuana case.  He was adamant from the start that he was not guilty. He had no interest in taking any of the plea offers that the state made him.  We prepared for trial and got a great result. The case being dismissed after a jury is sworn in is the same as a not guilty.

Dismissed – DWI – 6/7/2016

Our client was charged with DWI – 1st, a class B misdemeanor in the State of Texas.  Facing up to 180 days in the county jail and a fine of up to $2,000, our client elected to fight all the way to trial.  We showed up ready to fight and the state did not.  Case dismissed.  Our client is thrilled to avoid DPS surcharges of $1000/year on his license as well as a steep insurance increase!

Dismissed – Possession of Controlled Substance – 5/23/2016

Our client was charged with Possession of Controlled Substance, Penalty Group 1, less than one gram.  This offense is a state jail felony, punishable by up to 2 years in a state jail facility and a fine of up to $10,000.  In the 187th District Court, in front of Judge Steven Hilbig, the State elected to dismiss the charges against our client rather than proceed with our motion to suppress. Our client is thrilled to be able to put this episode behind him and move forward with his life.

1/22/2016 – Travis County, TX – Forfeiture Set Aside

Travis Couny sought the forfeiture of $2000 in a civil action against our client accused of marijuana crimes. We went to Travis and walked out with the civil suit dismissed and our client gets to keep his money. Another happy client!

In Bexar County Court #7, our client heard the two sweetest words he’ll ever hear, “Not Guilty,” twice today. He was charged with Assault Bodily Injury Married and Interfering with an Emergency Call. The State of Texas brought the purported victim to court and under an intense cross examination, her story began to crumble. We sent it to the jury with a confidence that our argument was strong. 20 minutes later, the jury returned an acquittal on both counts. We started out the new year right with a dismissal in Bexar County Court #7. Our client was originally charged with a felony, which was reduced and reassigned to Judge Euginia Wright’s court. In court on the day of trial, the State tendered a dismissal. This happened after we had attempted, unsuccessfully, to pick a jury in the case.
